Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") sets out the rules governing use of the WorkVisaCRM platform, operated by Green Outdoors Global Private Limited ("we", "us"). The purpose of this AUP is to ensure that WorkVisaCRM is used legally, ethically, and in a manner consistent with applicable laws and the rights of all parties involved in international recruitment.

By accessing or using WorkVisaCRM, you ("User") agree to comply with this AUP. This AUP is incorporated by reference into the WorkVisaCRM Terms of Service.

2. Permitted Uses

WorkVisaCRM is designed and licensed exclusively for lawful overseas recruitment and manpower deployment operations. Permitted uses include:

  • Managing legitimate overseas recruitment operations for the placement of workers in accordance with applicable laws in both sending and receiving countries
  • Maintaining candidate pipelines, including sourcing, screening, selection, and deployment records for workers who have given informed consent
  • Tracking visa case milestones, embassy appointments, and immigration documentation for properly authorised placements
  • Communicating with employers (clients) regarding the status of authorised recruitment and deployment operations
  • Generating reports and analytics to support lawful agency operations
  • Storing and managing documents with the knowledge and consent of the individuals concerned

3. Prohibited Uses

The following uses of WorkVisaCRM are strictly prohibited. Users must not:

3.1 Data Protection Violations

  • Store, process, or transfer personal data of candidates without their informed, documented consent
  • Use candidate data for any purpose beyond the stated recruitment and deployment purpose for which it was collected
  • Retain candidate data beyond the period for which consent was given or legally required

3.2 Exploitation and Trafficking

  • Use the platform to facilitate, plan, or conceal forced labour, debt bondage, human trafficking, or any form of worker exploitation in any country
  • Charge candidates illegal or excessive recruitment fees in violation of applicable national laws or International Labour Organization (ILO) conventions
  • Withhold, destroy, or threaten to withhold workers' identity documents

3.3 Fraud and Misrepresentation

  • Submit false, forged, or fraudulent visa, work permit, or immigration applications using data managed on the platform
  • Upload falsified documents, including forged passports, fake medical clearances, or fraudulent employment contracts
  • Misrepresent the terms and conditions of employment to candidates or employers

3.4 Legal Circumvention

  • Use the platform to circumvent, violate, or facilitate the violation of any law or regulation in sending or receiving countries, including immigration law, labour law, and anti-corruption law
  • Use the platform to conceal payments or transactions that constitute bribery, corruption, or money laundering

3.5 Technical Misuse

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the WorkVisaCRM platform
  • Scrape, extract, or systematically harvest data from the platform beyond normal use
  • Attempt to access another customer's data or accounts without authorisation
  • Probe, scan, or test the platform for security vulnerabilities without express written permission from WorkVisaCRM
  • Introduce malware, viruses, ransomware, or any malicious code into the platform

3.6 Communications Misuse

  • Use the platform or associated communication features to send spam, unsolicited commercial communications, or bulk messages without recipient consent
  • Impersonate any person or entity in communications made through or associated with the platform

3.7 Account Security

  • Share login credentials with any person who is not an authorised team member under the Customer's account
  • Allow competitors of WorkVisaCRM to access the platform through the Customer's account

4. Data Quality

Users are responsible for ensuring that candidate data entered into WorkVisaCRM is accurate, current, and complete to the best of their knowledge. Users must:

  • Obtain and document candidate consent before uploading personal data
  • Correct or delete inaccurate data promptly upon becoming aware of the inaccuracy
  • Not knowingly input false or misleading information about any individual

5. Compliance with Law

Users must comply at all times with all applicable laws and regulations governing overseas recruitment, immigration, labour rights, and data protection in both the sending country and the receiving country of each corridor operated. These include, without limitation:

  • Applicable national recruitment and manpower export/import regulations
  • Immigration and work permit laws of receiving countries
  • Data protection laws including the Digital Personal Data Protection Act 2023 (India) and GDPR (EU)
  • ILO conventions on fair recruitment and the elimination of forced labour

WorkVisaCRM is a software tool only and does not provide immigration, legal, or compliance advice. It is the User's sole responsibility to ensure their operations comply with applicable law.

6. Monitoring

WorkVisaCRM reserves the right to monitor platform usage for compliance with this AUP. Monitoring may include review of activity logs, usage patterns, and content uploaded to the platform to the extent permitted by law and our Privacy Policy. We will not routinely access candidate data without cause, but reserve the right to do so where reasonably necessary to investigate a suspected AUP violation.

7. Reporting Violations

If you become aware of any use of WorkVisaCRM that violates this AUP, please report it to us at crm@gogpl.in. Reports will be treated in confidence to the extent reasonably possible.

8. Consequences of Violation

Violation of this AUP may result in any or all of the following actions, at WorkVisaCRM's sole discretion:

  • Immediate suspension of the Customer's account without notice
  • Permanent termination of the subscription without refund
  • Reporting of the violation to relevant law enforcement or regulatory authorities
  • Civil legal action for damages arising from the violation

WorkVisaCRM's decision regarding AUP violations is final, subject to applicable law.
